For installations, you must own the property or have documented permission from the property owner.
Creditworthiness

Account Responsibilities
When you create an account with Clean Power Alliance or request services, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Account Security Obligations
You agree to provide accurate, current, and complete information during registration and to update your information to keep it accurate. You are solely responsible for safeguarding your password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password.

You may not use another person's account without permission, and you may not share your account credentials with third parties for unauthorized access to our services.
Payment Terms

For financed arrangements, you authorize Clean Power Alliance to share your information with our lending partners for credit qualification purposes. Financing agreements are subject to separate terms and conditions imposed by the lending partner. Interest rates, fees, and approval terms vary based on creditworthiness and other factors.

Late Payments
Late payment fees may apply as specified in your service agreement.
All prices are subject to change without notice. Quote validity periods will be specified in your proposal, after which pricing may be adjusted. Applicable taxes, permits, and interconnection fees may not be included in quoted prices and will be added as separate line items where applicable.
Property Access and Site Preparation
You grant Clean Power Alliance and our contractors reasonable access to your property for site assessments, installations, maintenance, and repairs as scheduled. You are responsible for preparing the installation site and ensuring that the site meets necessary requirements for the scheduled work.
Prior to installation, we will conduct a site assessment to evaluate structural integrity, electrical systems, shading, orientation, and other factors affecting system performance. Based on this assessment, we may recommend site modifications or additional work that may incur additional costs. Installation is subject to utility interconnection approval and any required permits.
Property Owner Responsibilities
You represent that you have authority to grant access to the property and that installation will not violate any homeowner association rules, covenants, or local regulations. You should consult with your HOA and local authorities before scheduling installation if such restrictions may apply.
Warranties and Disclaimers
Clean Power Alliance provides workmanship warranties on installation services for periods specified in your service agreement, typically ranging from one to ten years depending on the component and service type. Manufacturer warranties on equipment are provided by respective manufacturers and vary by product.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Actual energy production, savings, and performance results depend on numerous factors including weather, system orientation, shading, equipment characteristics, energy consumption patterns, and utility rates. We make no guarantees regarding specific energy production amounts or cost savings. Projections are estimates only.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAN POWER ALLIANCE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Damage Limitations
Our total liability for any claims arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim.
Excluded Damages
We are not liable for consequential damages, lost profits, or indirect damages regardless of the cause of action.
Some jurisdictions do not allow the limitation of liability for consequential or incidental damages, so the above limitations may not apply to you. In such cases, our liability shall be limited to the fullest extent permitted by applicable law.
Termination
Either party may terminate service agreements in accordance with the terms specified in those agreements. Generally, you may cancel certain services within specified cancellation periods, while financed arrangements or leased equipment may have different termination provisions including potential early termination fees.
We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Service. Upon termination, your right to use our services will cease immediately. Sections of these terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Governing Law and Disputes
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any disputes arising from or relating to these terms or your use of our services shall be resolved exclusively in the state or federal courts located in Denver, Colorado, and you hereby consent to the personal jurisdiction of those courts.
For certain disputes, you may be required to submit to binding arbitration rather than proceeding in court. Details about arbitration procedures will be provided when a dispute arises. By agreeing to these terms, you waive any right to participate in a class action lawsuit or class-wide arbitration against Clean Power Alliance.
